"The IRS thinks I already have an EIN"

Trust EINs, estate EINs, and prior sole-prop EINs all linger on file. Apply for a new one when the old one exists and you'll see codes 111 or 112.

Where prior EINs hide

Old 1041s, 147C letters, bank statements

Trustees and executors often inherit a prior EIN they don't know about. Look at past Form 1041 filings, the original EIN assignment letter (CP575 or 147C), or call the IRS Business & Specialty Tax Line at 800-829-4933 to retrieve it.

When to apply fresh

Don't double-up

Use the existing EIN. Applying for a new one for the same trust or estate creates a duplicate that has to be retired and creates downstream filing complications.

Expectation-setting
Only the IRS issues EINs. No service — formation operator, attorney, CPA, or EIN-resolution shop — issues EINs. What they sell is the labor of refiling SS-4 on your behalf, not a different outcome.
